Terms of Service

1. Agreement to Terms

By accessing or using JobWright ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

JobWright provides a cloud-based business management platform designed for trade professionals, including but not limited to:

  • Customer relationship management (CRM)
  • Job scheduling and dispatch
  • Invoicing and payment processing
  • Time tracking and employee management
  • Reporting and analytics
  • Mobile applications for field technicians

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent and warrant that you meet these requirements.

3.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.

3.3 Account Security

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

4. Subscription and Payments

4.1 Subscription Plans

JobWright offers subscription-based access to the Service. Subscription plans and pricing are described on our pricing page. We reserve the right to modify our subscription plans and pricing with 30 days' notice to existing subscribers.

4.2 Payment Terms

By subscribing to JobWright, you agree to pay all applicable fees for the subscription plan you select. Payments are processed through our third-party payment processor, Stripe. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for the renewal period.

4.4 Free Trial

We may offer a free trial period for new users. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. No charges will be made during the trial period.

4.5 Failed Payments

If a payment fails, we may suspend or terminate your access to the Service until payment is received. We will make reasonable efforts to notify you of failed payments.

4.6 Payment Processing Liability

When you enable online payment processing through Stripe Connect, you are solely responsible for all chargebacks, refunds, disputes, and negative account balances associated with your payment processing account. While payments are processed directly through your Stripe account, in the event that Stripe charges JobWright for any negative balance, loss, or liability arising from your payment processing activity, you agree that:

  • You are fully responsible for reimbursing JobWright for any such charges
  • JobWright may charge your subscription payment method for any amounts owed, plus a reasonable administrative fee
  • You will manage all customer disputes, chargebacks, and refunds through your Stripe dashboard
  • Failure to reimburse JobWright may result in suspension or termination of your account

This provision ensures that each organization bears responsibility for their own business transactions and customer relationships, as JobWright serves solely as a software platform provider and does not participate in or guarantee your business transactions.

5. Cancellation and Termination

5.1 Cancellation by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

5.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. We may terminate your account for violations of these Terms, fraudulent activity, or any other reason we deem appropriate.

5.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data. We recommend exporting your data before cancellation.

6. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Impersonate or attempt to impersonate JobWright or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone's use of the Service
  • Use any automated system to access the Service in a manner that sends more requests than a human can reasonably produce
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service to transmit any viruses, malware, or other malicious code
  • Interfere with or disrupt the Service or servers or networks connected to the Service

7. Your Data and Content

7.1 Ownership

You retain all rights to the data and content you upload to the Service ("Your Data"). By uploading Your Data, you grant us a limited license to use, store, and process Your Data solely for the purpose of providing the Service to you.

7.2 Responsibility

You are solely responsible for Your Data, including its accuracy, quality, and legality. You represent and warrant that you have all necessary rights to Your Data and that Your Data does not violate any third-party rights.

7.3 Backups

While we perform regular backups, you are responsible for maintaining your own backups of Your Data. We are not responsible for any loss or corruption of Your Data.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by JobWright and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

9. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, mapping services). Your use of such third-party services is subject to their respective terms and conditions. We are not responsible for any third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBWRIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless JobWright and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which JobWright operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

17. Entire Agreement

These Terms constitute the entire agreement between you and JobWright regarding the Service and supersede all prior agreements and understandings, whether written or oral.
